Howard bonding company defense is a success

Lindsey L. Howard, associate counsel with Goldberg Simpson, LLC, was successful in her representation of a bonding company, Defendant/Appellee, before the Sixth Circuit Court of Appeals. The Sixth Circuit affirmed the district court’s judgment in whole, and more specifically, found that Appellant’s breach of contract and quantum meruit claims against the bonding company were properly dismissed due to improper impleader; and Appellant’s claims for indemnification and contribution against the bonding company were properly dismissed for failure to state a claim.  The bonding company faced a multi-million dollar claim by a subcontractor on the project.
