The Goldberg Simpson trial team of Steve Smith and Sarah Tilley tried a construction law case this week in the Franklin Circuit Court before the Honorable Judge Thomas D. Wingate. Paralegal Joni Pardue also provided valuable assistance to the team. Goldberg Simpson represented the Commonwealth of Kentucky’s Finance and Administration Cabinet in this three-day bench trial, defending 15-year old charges by a bonding company that the Commonwealth improperly assessed liquidated damages against a steel fabrication contractor related to the Kentucky International Convention Center in downtown Louisville. Having to sift through over 40,000 documents and 15-year old memories of witnesses added to the complexity of what would otherwise be a “normal” construction law case. Though the Court’s decision is not expected to be issued for several months, the GS team is confident that the actions taken by the Commonwealth and its contractors will be proven to have been justified.
